RENTAL CONDITIONS
GENERAL TERMS AND CONDITIONS HOLIDAY RENTAL
Application
Our general rental conditions, as described below, apply to all bookings of holiday homes shown on our website www.idealrent.eu and on our Facebook page.
By booking a holiday home, the tenant declares to have read and agreed with the rental conditions below.
Only if the lessor agrees in advance and in writing to deviate from these general rental conditions. A deviation is only valid when stated on the booking confirmation sent by us to the tenant by e-mail.
Under no circumstances can the hirer claim the application of its own general terms and conditions or other terms and conditions to which it refers.
Holiday rental
- All bookings concern the short-term rental of a holiday home for recreational use only. Tenant is the customer renting the holiday home and all persons accompanying him; lessor is the owner of the holiday home or his agent.
- We only accept bookings from persons aged 23 or over.
- Parties and/or bachelor parties are not allowed in the holiday home.
Booking / Payment terms
- After submitting a booking request for a holiday home, you will receive a booking confirmation by e-mail with the general letting conditions and an invitation to pay the deposit.
- The deposit of 50% of the rental price must be paid into the bank account mentioned on the booking confirmation within 5 days of its dispatch. The rental agreement is only concluded when we receive payment of the deposit. If the deposit is not paid within the above deadline, the booking request will be cancelled and the dates will be released again.
- The balance of the rent and the rental deposit must be paid no later than 45 days before arrival.
- If the booking is made less than 45 days before arrival, the total rental price as well as the rental deposit must be paid within 5 days after the booking confirmation is sent.
- In case of late payment, we reserve the right to cancel the rental agreement and charge a cancellation fee.
- The landlord reserves the right to refuse a booking if it has strong suspicions that it does not fit within the general rental conditions.
Rental price / additional costs
- The rental price of the holiday home is indicated on our website www.idealrent.eu and is recorded in the booking confirmation.
- The rent includes "normal" consumption of water and electricity. This is stated on the website and is based on the average historical consumption of previous guests. If deliberate and/or excessive consumption is observed (e.g. leaving windows and doors open with heating or air conditioning on, leaving lights on during the day, charging electric cars, ...) a surplus is charged as stated on the website.
- The booking confirmation received by the tenant will list the additional costs to be paid in cash on arrival, such as final cleaning costs, use of linen, etc.
Rent guarantee
- The rental deposit varies per holiday home and is listed per property on our website www.idealrent.eu.
- The deposit must be paid no later than 45 days before arrival. If at the time of booking less than 45 days remain before arrival, the deposit must be paid within 5 days of sending the booking confirmation.
- If the rental deposit is not paid on time, the landlord has the right to deny the tenant access to the property, cancel the rental agreement and charge a cancellation fee.
- The holiday home is delivered to the tenant in good condition. The inventory is listed in the information folder. Complaints concerning the state of the house and/or the inventory must be notified to the lessor by e-mail within 4 hours after arrival at the following e-mail address: cs@idealrent.eu.
- The rental guarantee serves to cover damage and/or costs in the broadest sense of the term, which the landlord may incur as a result of the behaviour or non-fulfilment of the obligations by the tenant and persons accompanying him. This includes, without this list being exhaustive: damage to the interior and exterior of the accommodation, damage to the contents, loss or non-return of keys, leaving a safe locked, costs due to services ordered by the tenant, possible fines for inappropriate use or illegal activities, costs due to additional consumption of water and electricity, additional costs due to non-compliance with the rules on check-in and check-out and cleaning, as specified below.
- The rental deposit will be refunded to the tenant within 14 days of departure, less any damage and/or other costs identified. The amount of damage and/or costs deducted will be determined by the holiday home owner, and communicated to the tenant by e-mail with the attachment of useful photos and/or bills.
- If the damage and/or other costs exceed the amount of the deposit, the tenant is obliged to make an additional payment within the week following the notification.
Cancellation
- Cancellation by the tenant must be made in writing, by e-mail to cs@idealrent.eu, enclosing the booking confirmation. Upon receipt of the cancellation request, we will send a cancellation confirmation with the cancellation fee.
- If cancelled up to 45 days before the start of the rental period, a cancellation fee of 30% of the total rental price will be charged.
- If cancelled up to 30 days before the start of the rental period, a cancellation fee of 50% of the total rental price will be charged.
- Cancellation within 30 days before the start of the rental period will incur a cancellation fee of 100% of the total rental price.
- If the tenant does not arrive at the holiday home without prior notice, this will be considered a cancellation by the tenant.
- If the tenant leaves the holiday home early, he is not entitled to a refund of the rental fee.
- The cancellation fee due will initially be offset against payments already made by the tenant. If, after deduction of the cancellation fee, a credit balance remains for the lessee, the lessor will refund it within 10 days of receipt after sending the cancellation confirmation. If the payments made are insufficient to cover the total cancellation costs, the tenant must pay the balance within 10 days of the landlord's receipt of the cancellation confirmation.
- If the landlord is forced to cancel the rental agreement due to force majeure or weighty circumstances, any money already paid will be refunded to the tenant by the landlord.
Arrival and departure / keys
- On arrival, the holiday home is at the tenant's disposal from 16:00 h unless otherwise agreed. Only deviations confirmed in writing are valid.
- The tenant should notify the landlord of the time of his arrival in time for the landlord to give him the keys to the holiday home. In case of delay, the tenant should notify the landlord. If the tenant fails to do so, the landlord may charge a waiting time of EUR 20.00 per hour.
- Upon arrival, the tenant is obliged to hand over a copy of his identity card and that of the co-tenants to the landlord. No more persons may stay in the holiday home than specified at the time of booking. If additional persons stay in the holiday home without the knowledge of the landlord, an additional fee of 25% of the total rental price per additional person is payable.
- On departure, the tenant must leave the holiday home by 10.00 am at the latest, unless otherwise agreed. Only deviations confirmed in writing are valid.
- If the tenant fails to leave the property on time, he may be charged an extra day's rent.
- On arrival, the keys to the holiday home will be provided to the tenant. The keys are only given to the tenant on loan and remain the property of the landlord.
- In case of loss, theft or any other way of losing the keys, the cost of replacing the locks will be charged to the tenant.
Liability and obligations of the tenant
- The main tenant, his fellow tenants and his visitors, must occupy the holiday home with due care and diligence, respecting the peace and quiet of local residents. If noise or nuisance is caused to local residents, the landlord has the right to remove all persons present in the holiday home without prior notice, without any refund of the rent being due.
- The holiday home is delivered to the tenant in good condition. The inventory is listed in the information folder. Complaints concerning the state of the house and/or the inventory must be notified to the lessor by e-mail within 4 hours after arrival at the following e-mail address: cs@idealrent.eu.
- The tenant is liable for all damage (damage, loss, disappearance or complete destruction) found, even after his departure, to the house, the household effects listed in the inventory, and all items belonging to the rented holiday home, unless he can prove that this damage cannot be attributed to himself, his co-tenants and his visitors. He is obliged to report any damage to the landlord as soon as possible.
- If damage is observed during the stay or after the tenant's departure, the tenant will submit to the determination of this by the owner of the holiday home. The damage will be communicated to the tenant by e-mail, enclosing useful photos and/or invoices, and will initially be deducted from the rental deposit. If the rental deposit is insufficient to cover the damage, the tenant will be required to make an additional payment within the week following the notification.
- The tenant is not allowed to sublet or give permanent use of all or part of the holiday home to a third party.
- The use of narcotics in the holiday home is prohibited. Breach of this provision will result in immediate termination of the rental agreement. In this case, the tenant and all persons present must leave the holiday home immediately, without refund of the rental fee and the rental deposit.
- Smoking is not permitted inside the holiday home. Smoking is allowed outside, but the tenant must remove cigarette butts.
- Parties or bachelor parties are not allowed in the holiday home.
- Pets are not allowed in the holiday home, unless previously agreed otherwise. Only deviations confirmed in writing are valid. If an unauthorised pet is found, the landlord may retain the rental deposit as compensation.
- It is not allowed to move the furniture present.
Liability and obligations of the lessor
- All information regarding the holiday home, location, layout, furniture and other facilities provided on the internet or elsewhere, is provided in good faith. Should changes occur between the time of booking and the start of the rental period, the lessor will inform the lessee to the best of his ability, but cannot be held liable for them.
- The landlord is not liable for theft, loss, damage or injury of any kind to the tenants of the holiday home and their belongings.
- The landlord is not liable for nuisance of any kind caused by road works and construction activities in the vicinity of the holiday home.
- The landlord is not liable for damage caused by storm, lightning strikes, floods, rise or fall in the groundwater level, natural disasters, nuclear disasters, attacks, strikes or acts of violence, aviation accidents and other calamities.
- The landlord is not liable for failure of technical equipment, utilities, internet and wifi if present.
- If a defect occurs in the holiday home during the rental period, the lessee is obliged to report it to the lessor as soon as possible. The lessor will try to remedy this as soon as possible. However, defects do not entitle the tenant to a refund of the rental fee or any form of compensation.
Final cleaning
- Upon arrival, the tenant is obliged to pay the price for "normal" final cleaning and bed linen in cash to the landlord. This price differs per type of property and is listed on the website.
- The tenant is obliged to leave the accommodation, terraces and garden in a clean and tidy condition. emptying the dustbin and taking the rubbish to the appropriate containers, removing food from the fridge, freezer or other cupboards, emptying the dishwasher and putting the clean dishes back in the cupboard, tidying the sink, flushing the toilets, clearing cigarette butts and rubbish outside, cleaning the BBQ if present.
- Non-compliance with these obligations will lead to subsequent additional charges that will be deducted from the rental deposit:
Failure to remove bin bags to containers: €25
Failure to empty the fridge, freezer and/or other cupboards: 25 euros
Non-emptying of the dishwasher and non-return of clean dishes: 25 euros
Cleaning of garden, terraces and BBQ: €25 per hour
Cleaning ovens, dirty dishes, kitchen equipment: 25 euros per hour
Cleaning of abnormally soiled homes: €25 per hour
Urine, blood or other traces on sheets, duvets, carpets, seats, etc.: price professional cleaning
This enumeration is not exhaustive.
Complaints
- Shortcomings and defects in the holiday home should be reported to the landlord as soon as possible so that the landlord has the opportunity to find an appropriate solution.
- If the deficiency or defect is not resolved within a reasonable period of time and detracts from the quality of the rental, the tenant must again notify the landlord.
- If after this no solution is offered for the shortcoming or defect, the tenant must submit a written and motivated complaint to the landlord by mail as soon as possible. (cs@idealrent.eu) If the complaint is found justified, the landlord will propose fair compensation to the tenant.
Jurisdiction and applicable law
In case of dispute, Spanish law shall be exclusively applicable and the Spanish courts shall have jurisdiction.
Privacy and GPDR
- In accordance with applicable privacy and GPDR regulations, the landlord will process the tenant's personal data. Under no circumstances may this data be passed on and/or sold to third parties.
- When booking, the tenant agrees that the landlord may collect his personal data and contact him in the future with a view to a future booking of a holiday home.
- On simple request, the tenant can have their personal data amended or deleted by sending a request by email to cs@idealrent.eu
